Welcome to hikeherworld.com. The hikeherworld.com website (the “Site”) is comprised of various domains operated by Hike Her World (“Company”), domains include campherworld.com, backpackherworld.com, and gardenherworld.com. Hikeherworld.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of hikeherworld.com constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for your reference.

Hikeherworld.com is a drop shipping site and blog providing products and information related to outdoor recreation and activities as it relates to women in general, but not exclusively. Our site is accommodated by Wix.com, which provides us with the online e-commerce platform that allows us to sell products and services online.

Hikeherworld is located in Oregon, USA. Hikeherworld does not have a sales tax liability in the state of Oregon, and therefore, has no obligation to collect sales taxes on behalf of any other state. If you are a purchaser outside of Oregon, and your state imposes a sales and/or use tax, you are solely responsible for any taxes owed for any purchase made through this website, and are obligated to pay these taxes to your state.

Returns/Cancellations/Refund Policy

Once an order transaction has been made, it may not be possible to stop or cancel an order in fulfillment or transit. You may have to wait until order is received, then process a refund. Most purchases can be refunded within 30 days of original receipt or purchase transaction, for defective and or damaged items, depending on the supplier; however, this may not apply to “non-defective remorse returns”. Because we offer a bespoke collection of products through various suppliers, our suppliers are responsible to accept or deny a return/refund of their products and therefore, set the limitations and policies for refunds or returns for their products. We advise you to check individual product pages for return/refund policy on that specific item.

Each item may vary on return/refund policies, and customers may not be given a full refund if the supplier charges a “restocking & repacking fee”. If supplier accepts the after-sale request for the reason type of “non-defective remorse returns” and requires deduction of a “restocking & repacking fee”, the “restocking & repacking fee” in total supplier deducted shall not exceed 35% of order total price. Order total price may not include taxes, shipping costs or other fees incurred by customers to receive the original order. If you receive the wrong order, item, size or color than ordered (except in cases where colors may be substituted at the supplier’s discretion, based on inventory for item requested), or any other order detail that results in the customer not receiving what was ordered, at no fault of the customer, will be refunded by hikeherworld.com. If the customer requests a refund or replacement, but item(s) is received as ordered (i.e., customer enters wrong size, color, or quantity at checkout) at no fault of hikeherworld or their suppliers, refunds and/or returns may not be accepted.

In all cases, when a customer receives damaged or defective items, it is the customer's responsibility to request, to notify, and to supply photos and/or video of problem along with support documentation (packing slip, order receipt, proof of purchase, etc.) to the seller, within the designated time allowed to qualify for a refund or replacement.

International Users

The Service is controlled, operated, and administered by hikeherworld from our offices within the USA. If you access the service from a location outside the USA, you are responsible for compliance with all local laws and regulations. Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provision hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final, and judgement may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regard to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver

Any Arbitration under these Terms and Conditions will take place on an individual basis, class arbitrations and class/representative/collective action is not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE, AND/OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and hikeherworld agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

Termination/Access Restriction

To the maximum extent permitted by law, this agreement is governed by the laws of the State of Oregon and you herby consent to the exclusive jurisdiction and venue of the courts in Oregon in all disputes arising out of or relating to the use of the Site. You agree that no joint venture, partnership, employment, or agency relationship exists between you and hikeherworld as a result of this agreement or use of the Site. Hikeherworld’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of hikeherworld's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by hikeherworld with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provisions will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
